Consumers filing for bankruptcy must obtain consumer credit counseling within 6 months prior to filing date. Some jurisdictions require that you obtain CCCS counseling at least the day before you file the BK or your case can be dismissed. This does not, however, mean that a consumer must develop or create a repayment plan before filing the bankruptcy.
How Do I Get Credit Counseling?
To obtain credit counseling services you must participate in an interview with a non-profit credit counseling company that is approved by the office of the United States Trustee. In most cases, this credit counseling will take about an hour and can even be done over the phone or web. The fees for credit counseling are minimal.
